Maybe I'm just stuck on stupid.
Here's the question after reading the NFA handbook.
SBR's are a $200 tax ? But, if your dealer has one he can sell it to you and transfer it for $5 ?
If this is stupid is as stupid does, by all means I can take a slapping. :D

That's only for the transfer of AOW's.
Example: Lets say you transfer to your dealer a (crappy) AR pistol. He logs it in his book. He then submits a Form 1 (?) to manufacture an AOW (Any Other Weapon). He receives his form back, and then transfers to you your shiny new AOW to which you may put a vertical grip on and the transfer is only $5.
I think this can also work with AOW shotguns but they're not allowed to have a stock, otherwise it'd be a SBS (short barreled shotgun) and require the $200 tax.
I think I have that right.
$5 transfer amount applies to AOW (any other weapon)
A weapon registered as an SBR will always cost $200 for a transfer to a non gubment entity.

I just talked with a class dealer that I did some suppressors from and your right.
$200 tax stamp fee for the SBR. As he explained it, the Form 1 is an end user type form. I can order and recieve the SBR upper, then apply for the SBR with the form 1's and money order for the tax stamp.
"Just don't pin the SBR upper on your lower until at which time you have stamped Form 1's in your hand from the BATFE"
Oh, and find someone can stamp you lower with the proper data.

I wouldn't even have an SBR upper in the same house with a complete rifle. While the odds of having trouble with the two would be very slim, the consequences of that trouble would be severe, to say the least.
MisterWilson is correct. It's not worth the felony you'd get charged with to have both an SBR upper and ANY AR15 lower in the house (complete rifle or separate lower). Having the two in the same house shows "intent" even if you don't intend to put the two together without the stamp. It's not like the BATFE has your house under surveillance when you decide to go the NFA route, but all it would take is having a break-in or fire or some other event that brings official attention to your residence. If you get caught with an SBR upper and an AR15 lower with no tax stamp, life will get a bit uncomfortable...
Get the lower legally registered, THEN buy the upper.

Thanks everyone for the replies.
I'm glad I came here first. The lower is an LMT Defender with SOPMOD stock and I was going to order the LMT CQBR 10.5" upper.
I'll just register this lower then get the upper once my Form 1's are stamped.
I don't want any trouble either way.

Will do !! But it may a little while with the BATF wait. ;)
I plan on possibly the DD Omega rail, the new TD VFG, A2 rear LMT BUIS, Aimpoint or EOtech 512 (own both) and the KX3 hider with either a Surefire G2 on a DD or LT offset mount. I'll keep it simple. :cool:

You're going to love that upper. I've got one and everything I've ever heard about them is that they're dead nuts reliable.
If I could describe my LMT 10.5 in a word: Tits.
I'm wanting to do a very similar setup to my SBR. I have the LMT BUIS, EOTech, and a KAC RAS, but need a few more things...
BATFE takes a bit but it's not bad. Mine took about six weeks total.

I like the LT rail system. I guessing that is a 9" rail ? With Troy's front and rear ?
I don't have the tools to do a self install of the LT rails, let alone know what I'm doing with a LP gas block. Reason I said I'd keep it simple and do a DD Omega rail and then dress it out accordingly.
One question. Which buffer ? H, H2, H3 ?
I've already got a PRI gas buster charger for it with the LMT BCG group.

Neither, regular carbine buffer. That's what I love about the LMT, it just WORKS.
Also, that's how I had it set up yesterday. Just today I re-arranged things.
(Traded the LT for a CASV, reinstalled the FSB, traded the SOPMOD stock for a Modstock, and traded the right-handed Ergo for a TD)
Just because I'm not EOD doesn't mean that I can't play with their toys....

Gave it a BIGTIME diet. In addition to feeling much better balanced and lighter overall, it's also considerably shorter.
In all, it's EXACTLY what an SBR should be in my humble opinion. Since I got home today I haven't been able to put it down. It's just so light & handy.
Also, while I normally don't like single point slings, this rifle is just short & light enough that it might fly without going all over the place. Normally I like an adjustable two point but I might have to change habits for this one.
Now Aimpoint micro or Accupoint TR21...T-1 or TR21...Fish or cut bait...
Agree on the single point being a better option. I think I'll go that route as well.
I have the T1 on a LaRue but I think it's a bit too tall... If I could do it all over again I think I'd get the ADM mount for it. Otherwise I really like the light weight of the T1. That said, I think I'll put an EOTech on the SBR. I just really like that sight picture!

That looks great !!! Not sure about the Vltor system. I looked at it over on their home page. If I did a "color" type SBR such as yours, then I like it alot and you can obviously place rails where you need them or want them.
That's one nice rifle. I'm now pondering the Vltor system. :cool:
But, I'm getting ahead of myself. First I have get this lower registered, then the goodies next after I purchase the LMT upper.
Again, nice looking rifle. I'm envious. :(

I'd had an Eotech 552 that I'd *just* sold. I put it on top of this for a moment and I didn't like it, too high. Doesn't co-witness and I'd have to alter my cheek weld. I'm used to getting as low as possible and with the Eotech I'd have to pop my head up a little bit...Totally not used to it.

Dude, if you want to believe that having an SBR upper and spare lower lying around won't have the potential to pose any problems, then more power to you.
Based on the consequences of a worst-case-scenario, the rest of us will happily err on the side of caution.
As for rolling your eyes, didn't your mother ever tell you that if you keep making that expression your face might freeze like that?
Lower, THEN upper. Not worth the risks involved.
MisterWilson, I understand where you are coming from on the EOTech. For me, it was the first optic I ever used (going on 8 years ago now) and I just LOVED the sight picture. Love the Aimpoints too, so reckon that's why I have both.
Guess that's why there are so many flavors of ice cream... :D

I have no problem with "err on the side of caution". It's the intent nonsense that isn't going to fly with me. You can take that line of thought to all kinds of ridiculous conclusions. I always use the example of cleaning chemicals under the sink. They could be cocktailed into an explosive device.... therefore there's an intent to build an unregistered DD?
I know we all want to avoid any governmental entanglements, but every time the ATF rams it up someone's ass.... after all the internut drama and dust settles... you'll always find out that it was some asshole who had it coming.

A guy/gal gets on this forum asking for opinions. That's what he gets. Now, if someone on here is an attorney who has a solid background in NFA laws and he comes in and says it's no problem, I MIGHT listen. But then again, I might not. What I have in life now I've worked too hard to get and I won't jeopardize it by being impatient... And that's going to be my exact opinion when someone asks...

I get a kick out of those hysteria filled nonsense ranting threads and all the armchair internut lawyers that come out of the woodwork to post in them as well. But I agree, I'd also prefer to read them on TOS for a chuckle now and then and not here.
