    Yep. Prohibited person is the only requirement.

    How do you guys know if a buyer is a felon or worse, a psycho? Does simply asking them satisfy the seller's legal obligation?

    Your actually not obligated to ask anything. You’re not an FFL and not subject to those requirements. What you cannot do is sell to someone you know is a felon or can’t possess a firearm. You don’t have to ask.

    You also don’t have to do a bill of sale, or verify anything. I have done dozens of face to face sales and have never done a bill of sale, mainly because I haven’t murdered anyone with my firearms.

    I only sell to folks that can provide a valid CCW. That makes me at least feel better about knowing they were clear within the last couple years. I also always do a bill of sale in case it gets used to commit a crime and I get to be one of the stopping points on its track back to origin.

    I don't keep receipts because I don't want to aid infringements of the RKBA.

    I understand that viewpoint, as well as the others expressed in this thread.

    I feel if you sell a firearm without a paper trail you are setting yourself up for trouble if someone later uses the firearm in a crime. It can be traced back to you, and that could be trouble for you.

    Manufacturers and distributors have to keep records of where they ship firearms; the FFL holder has to keep a copy of the 4473 for every firearm transferred. If any of those entities go out of business they are required to ship their records to ATF. When LE comes across a gun used in a crime, they contact ATF. ATF contacts the Mfg, then using the info gained from the Mfg they go down the line until they get to the FFL who sold the weapon. The FFL has to provide them a copy of the 4473. If the FFL is out of business, the ATF has the FFL's 4473's in storage and they have to manually locate them, but it can be done, there been a paper trail since 1968.

    For that reason, if I had to fill out a 4473 on a firearm, I have proof of who I sold/gave the firearm to.

    I know someone who sold a weapon which was later used in a homicide. He told them it was a private sale along with some other details and the BATFE couldn't have cared less. He wasn't the subject of the investigation.

    I'm more concerned with something that doesn't have a suspect, only a gun with no good prints on it left at the scene.

    I agree not a likely scenario, but possible.
