    SBR Upper / NFA question

    Ok this may be a stupid question but indulge me I'm new to NFA stuff. Is an SBR upper by itself a controlled item or only when pared with a lower receiver? The reason I as this is could I assemble / purchase a SBR upper before I do the paperwork and just not use it? I was wondering since all the tax stamp info goes on the lower.

    The uppers are not controlled or taxed by themselves. They could be destined for an AR pistol, or for a long permanently attached muzzle device. In both cases, the use would not be a NFA item.

    The upper itself is not a NFA controlled item.


    It is not okay to assemble it and just not use it if you do not have an appropriately registered lower receiver (SBR, MG, etc).
