What is the site TOS that everyone is refering too?
There are times when things need to be sent 'Adult Signature Required' via the US Mail to put those parties on notice of the infringement and your intent to seek relief. Lawyers are good at penning these sorts of things and the deep pockets will pay your legal fees if you prevail. EMail is an advance heads up but when the post man makes them sign for a letter they will not slough this off.
Business is business. Everyone is having to purchase the magazine to read the plagiarized article. They are making money off this and my guess this humiliation is causing damages that are yet to be calculated.
Food for thought. It depends on how you feel along with the sponsors of this board.
I have been advised by more than one attorney that I have virtually zero legal recourse due to the original chart being posted on the web. I am not looking for compensation, just to set the record straight.
Wow, I would be pissed, too.
As someone who writes for publication from time to time, I take it for granted that doing anything like that would make my reputation be toast and make me unable to sell anything again.
You may not have legal recourse financially, but you can still set the record straight and make the guy look like a plagerist. All someone need do is check the dates of the earliest postings of your chart.
I think people consider David Crane questionable to begin with.

i could be wrong, as i often am, but I'd wager arfcom gets more hits in a day than they sell magazines in a year. and that's before you count the 30+ other gun sites that chart has been posted to.
i had to look it up as i didn't recognize the name of the magazine when it was first mentioned.

I see this as entirely possible and will be interested to see how this plays out now. I'm glad I copied him on the emails and will be interested to see how the editors and publishers respond.I didn't include a chart of any kind with the article I submitted to
Harris, and I ALWAYS give credit where it's due. The chart you write
of must have been added later. I've never seen it. Can you email me a
scan of the page? I haven't seen the published article, yet. I don't
have a copy of the magazine, yet.

I frankly see no reason to talk to him, although I can see why he'd be upset. I'll see what the publishers and editors have to say about it.Thanks for sending me the charts. Again, for the record, I didn't
supply any chart with the Mil-Spec article (or any other article) I
submitted to Harris. That chart must have been added by the editorial
staff. Before you just sent them to me, I had never seen your chart or
the chart that's contained in the article.
The problem now is that you've basically jumped the gun (excuse the
pun) and accused me--in writing and to multiple people--of plagiarism,
which I did not commit. You did this before you had all the facts and
without contacting me first to ask me about it. The question now is
how your original email accusation is going to affect my professional
relationship with the Harris hierarchy and/or my writing career in
general.
Perhaps the more prudent course of action on your part would have been
to contact me first, communicate the situation, and get my side of the
story before sending out a multiple-recipient email accusing me of
creative malfeasance.
Again, please feel free to contact me by phone, if you'd like. While
I'm not very happy with the way you've handled things so far, I'm
still willing to speak with you.
