    Buying NFA in CO while living in CA?

    Hey guys,

    Im currently stationed in San Diego, I live off-base. My home of record according to my drivers licence is still in Colorado, and I always make sure to update that licence so my CO residency stays current and so CO takes my taxes. The problem is, my CA address is used for my: rent and utilities, credit card, bank account etc. If I go back to CO on vacation, will I run into any snags while filling out NFA paperwork because of this?


    Also, can I SBR a lower I currently own?

    I'm not sure but I think you are a California resident now that has just not changed his driver's license...

    I have federal exemption to becoming a state resident of California since Im MIL. It entitles me to any benefits of living in CA while not becoming a resident, its nice.

    Personally I would contact a lawyer to make sure I didn't screw myself in this situation. Douglas Turner is the lawyer that did my NFA Trust. He's a local Colorado guy and specializes in NFA weapon issues. Here's his website. If you don't already have a trust and you set one up with him, you get an hour of picking his brain about all the legal issues you what as part of the trust fee. I think it was $250 to have him set it up, but don't quote me on it. I'm sure for an hourly fee he's answer you questions without setting up a trust.

    Where do you vote? Absentee ballot? Do you still have a physical address in Colorado?

    When I was in the Military, a long time ago, I was still considered a resident of my home state temporarily assigned elsewhere. When I was stationed oversees I was still considered a resident of my home state and not a foreign country.

    I think there are some questions to be answered, but I think you could purchase in Colorado. The gun would have to stay in Colorado as California is not very NFA friendly.

    Just curious, you wrote "It entitles me to any benefits of living in CA while not becoming a resident, its nice." It leaves me confused as I did not think there were any benefits to living in CA.

    Yes you can SBR a lower you own now. Check out How to SBR Your Lower by Scotty Ryan.

    The only issue I can see is where you will store your SBR. If you go the trust route your could leave the gun in Colorado with a Trustee say your Mom, Dad or a Brother or Sister. Really anyone you trust enough to name a Trustee.

    If you can have a trust done up by an attorney for $250 jump on it that is a fair price and you have some unique circumstances and the legal advice will help you make the right choice.

    I am not a lawyer and I only play one occasionally. Having once been a citizen of the PRK and military member I am pretty sure that your being stationed in CA won't be an issue as long as the item stays in Colorado. Obviously a trust would be the way to go in this matter.

    Having a trusted relative and a residence in NM is why I elected to go the trust route, and pick up fun toys (been stationed in CA and HI), so if you have that luxury, then that seems like the most reasonable option.

    You are good to go with your Colorado Residence. First talk to the CLEO there to see if you can get the signoff, then buy or make your stuff.

    You can not take it into CA but can get it as close as AZ for storage.

    He doesn't need to talk to a CLEO if he is using a trust.
