    SBR state regs

Well everyone I have a quick question im looking at getting a sbr. The only thing is that I am in the military and will be getting moved around. Right now im in a free state but that might not always be the case. So heres the question being in the military and possibly living on base will that exclude me from the states regulations on sbrs? If not how do i go about keeping the rifle without leaving it at a family members place?

    Your options are:

    1. Leave it at a relatives in a safe only you have access to in home state.
    2. Put in it a safe deposit box at a bank in home state.
    3. Sell it.

Another option is to put a legal length upper on it and then it's no longer an SBR.

Correct. And in that case I would make sure that the other upper is not around. I would keep it secured until I returned to a NFA friendly state.

But be careful. Certain states (CA for example) have "listed" specifically banned lowers.

That's not part of this dicscussion. It's the OP's responsibility to make sure that he complies with state law. We are addressing the SBR aspect.

Is this really correct? It is the lower that is the registered SBR not the <16" upper... I had heard, so take it for what it is worth, that the only way for it to not be an SBR after registering it as such is to have it removed from the NFA registration...

I've run into this as well as a military member. I honestly try to get stationed in friendly states but that is really just a crap shoot. I've had to take my suppressors to live with my dad - I put them in an aluminum pistol case that is locked and he can't get into them. I was able to keep my SBRs at my current location (also don't forget to send in the correct AFT forms for moving your SBR).

You are also subject to all state gun laws on base. I have heard there is an exemption for military members moving to CA regarding their assault weapons ban.

This is what the BATFE says on their website. Read this little thread.

If you were to register the SBR through a trust, then you could add the name of a family member to the trust and they would legally be able to possess the weapon.

This would seem the safest overall bet to me, and covers all your bases legally.

Exactly. This is why I did my trust as well. If I am overseas the wife can do what she has to. In additon if something happens to me then she has custody and can do what is necessary.
