Obama warns the Supreme Court. :rolleyes: Really? What's he going to do if it doesn't go his way? Usurp the Supreme Court like he has done to Congress?

President Obama, employing his strongest language to date on the Supreme Court review of the federal health care overhaul, cautioned the court Monday against overturning the law -- while repeatedly saying he's "confident" it will be upheld.

The president spoke at length about the case at a joint press conference with the leaders of Mexico and Canada. The president, adopting what he described as the language of conservatives who fret about judicial activism, questioned how an "unelected group of people could overturn a law approved by Congress. "

"I'm confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress," Obama said.

The Supreme Court spent three days hearing arguments last week in four separate challenges to the health care law, which stands as the president's signature domestic policy accomplishment. A central challenge was over the individual mandate -- the requirement that Americans buy health insurance. Critics say the mandate is unconstitutional, and that the federal government cannot force people into the insurance marketplace.

Obama on Monday said that without such a mandate, the law would not have a mechanism to ensure those with preexisting conditions get health care.

"I'm confident that this will be upheld because it should be upheld," Obama said, describing the law as "constitutional."

Republican lawmakers slammed the president for his Supreme Court comments. Sen. Orrin Hatch, R-Utah, accused the president of misrepresenting the implications of a ruling against the law.

"It must be nice living in a fantasy world where every law you like is constitutional and every Supreme Court decision you don't is 'activist,'" he said in a statement. "Many of us have been arguing for nearly three years that the federal government does not have the power to dictate individuals' purchasing decisions. After a national debate on the subject, more than two-thirds of Americans agree that the Obamacare insurance mandate is unconstitutional."

Yeah, the same Congress that completely flipped over in the 2010 midterms...

He doesn't seem too fond of SCOTUS right now. But he didn't hesitate to put two radically liberal justices on the court.

I'm very disappointed in him for making the office of POTUS look ignorant and childish while in the presence of two foreign dignitaries. Dignitaries that have had negative consequences as a direct result of his arrogance (Fast & Furious and Keystone XL Pipeline).

What part of "separate but equal" does he not understand? What part of "democratic Republic" does he not understand?

Now I know how the Dixie Chicks felt. For that, I cannot forgive him. :(

Isn't it ironic that he only views SCOTUS as "activist " when they may disagree with his agenda. I was appalled at his veiled threats and pray that it will incite the Justices to prove a point about the separation of the three branches of government. Barry has always viewed his role as the supreme dictator who is not to be challenged.

To me this is just more proof that this moron wants a single-branch, socialist government. I would be willing to bet that he, his cronies, and his handlers would jump at the chance to outlaw the Legislative and Judiciary Branches.

A federal appellate judge in Texas on Tuesday demanded that Attorney General Eric Holder write a three-page, single-spaced memo by midday Thursday explaining why the federal judiciary can strike down federal laws on constitutional grounds, according to a lawyer who was in the courtroom.

The request — from 5th Circuit Judge Jerry E. Smith, a Ronald Reagan-appointee — seemed to be a direct shot at Obama, who said Monday that the Supreme Court would be guilty of an “unprecedented” act of “judicial activism” if it strikes down the health care reform law.

Smith made the request during oral argument on a case involving physician-owned hospitals according to a press release from Physician Hospitals of America. The arguments Tuesday were over whether the health care reform law’s limitations on new or expanded physician-owned hospitals are constitutional. Physician Hospitals of America and Texas Spine & Joint Hospital filed the lawsuit in 2010. Most of the lawsuits against the health care reform law are on hold pending the Supreme Court’s decision on the constitutionality of the individual mandate, but this case was allowed to move forward because it covers a different piece of the health care law.

A lawyer who was in the courtroom said the request came before a Justice Department attorney could begin her argument in the case.

Jay Carney was already on TV this afternoon explaining that what Obama said didn't mean what we all thought it did. Apparently POTUS momentarily went all "off teleprompter" on us. Personally, I think Jay Carney has one too many "e's" in his name. :rolleyes:

Holder will refuse to answer and this judge might issue a summary judgement against him because of the refusal. It would certainly serve him right! :(

The Supreme Court has overturned federal laws passed by congress no less than 150 times, the first being Marbury v. Madison. And they have overturned more than a thousand laws passed at the federal, state and local level combined. Unprecedented my ass.
