Texas Proposal: JAIL Any Federal Officials Trying to Enforce New Gun Restrictions in the State




A Texas lawmaker says he plans to file the Firearms Protection Act, which would make any federal laws that may be passed by Congress or imposed by Presidential order which would ban or restrict ownership of semi-automatic firearms or limit the size of gun magazines illegal in the state, 1200 WOAI news reports.

Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state.




Texas is the second state to propose a measure to shield the state from the impact of any gun possession restrictions imposed by Congress or by Presidential order. A similar measure was introduced in Wyoming last week




Now if Texas would have the balls to secede, I'd be all set! :cool:

I sent letters to my state reps asking them for legislation barring any state agency or LE from cooperating with the Feds on any new gun laws!

Wyoming also has a bill that mirrors the sentiment in the Texas bill.

Colorado is Dem controlled through and through, they will ban all guns before passing legislation like this.

Last time that happened, Texas didn't have a lot of major Federal military bases on its soil and it seceded with 10 other states. If I recall correctly, Texas lost.

I think they could win this time.

On a related note, the White House has answered the online petition by saying that Texas does not have the right to secede.

Still, if enough states say, "Up yours" to new gun legislation, that is tantamount to "soft" secession.

There is a similar bill being drafted for introduction during the 2013 Montana legislative session. I plan on watching it closely.

While such a measure would obviously face judicial challenges, it damn sure sends the right message.

Jailing federal official from executing their duties is going to stand as long as a snowball in Hell.

They can however mandate that no state resourced be used for the enforcement of federal law. If memory serves correct, this was upheld already during challenges to the Brady Bill. AFAIK there is no law requiring local LEO to work with the Feds or via versa, so they could just ignore each other. No more SWAT teams for DEA raids. Not more local LEO escorts for ATF guys...

Secession would end badly for the states trying it.

I don't know...the American people don't have a problem bombing other places...but there's no way in hell they'd get behind another Civil War as it was. Hell, we fight the War on Terror a hell of a lot more humanely and with more respect to the rights of the enemy than the Union did fighting the Confederacy.

I think a lot of people would be like "HAHA let's see what they can do without almighty us!" But then we'd be fine.

Most of these people that think Texas would have a hard time don't seem to live here....



Also while the bill being discussed wouldn't stand up in court, it sends the right message as to what we believe and how we intend to go about business.

These rights are not granted to me by the Bill of Rights, they are not subject to political whims, nor are they something that can be regulated. They are inherent to my humanity. Local and state LEO's who have tried to enforce federal immigration laws have been threatened with lawsuits and arrest by the Justice Department.

If a federal LEO violates a state law, what happens?

I honestly do not know, and am asking. I did web searches and found conflicting answers.

I don't have it on good authority, but I have heard that the Wyoming bill was proposed in 2009, and has been in appeals ever since. Still, I am hopeful.

Look up the Supremacy Clause. Basically Federal law trumps state law, and the states cannot hinder the Feds from carrying out law enforcement.

What we can do is keep our states from helping the Feds enforce Federal law, and make the Feds do it all on their own. The Feds rely a lot on local law enforcement for help and without that they would be severely hindered. You usually don't run into Federal law enforcement out and about do you?

We need to get the same type of thing the states who have legalized pot are doing with drug laws, and barring their state LE from working with Federal law enforcement on drug cases or even referring cases to them for investigation.

So say magazines are banned over 10rds on the Federal level, and like NYS there is a 1 year amnesty period to sell them or destroy them, and after that year a TX State Trooper pulls you over, and finds 30rd mags in your car they be barred from referring you to the ATF (or whoever else) and have to let you go on your way.

the one thing about the supremacy clause though is it has to be constitutional ! and that is where the argument is going to be that going against the 2nd

our gov is so screwed up these days !!! I sadly dont know about the future of our country at times it really makes me wonder what is going to happen ?
