Yes, but by agreeing to Facebook's terms and conditions for your account you open yourself up to Facebook.

I don't recall agreeing to any terms and conditions with the NSA...

You don't have to sign up for FB to be tracked by FB.

Having your information knowingly farmed for advertising purposes is FAR less evil than the NSA farming it against your knowledge to incriminate you criminally. Not sure how anyone can even think these are on the same level.
