in block 2E states that "a photographc of his/her frontal view taken one year prior to the date of the application and (2) subtwo fbi finger print cards.


Are they trying to hold us up two years now for NFA items??? this is how I read it. Looking at my form 4 it says taken within the last year, totally different wording.

Did they make a mistake or is this some new ruling? how are they going to tell if its a year old photo?

It's most likely a typo. It would make sense if it read 'taken no more than one year prior.' That just a wild guess, though.

The header of that section reads:

A maker who is an individual must complete this Section.

From the ATF release notes.

The ATF Form 1 has been revised to allow the payment of the making tax by use of a credit or debit card. This is a new option that was requested by the industry. Payment by check or money order will still be allowed when the application is submitted on paper.

The Form 1 and Form 5 have been revised to incorporate the questions relating to non-immigrant status that are contained in ATF Form 5330.20, Certification of Compliance with 18 U.S.C. 922(g)(5)(B). Form 5330.20 is to be submitted when the applicant maker is an individual, not a legal entity. With a submission of the revised Form 1, the submission of Form 5330.20 will not be required. This revision was also requested by the industry.

This update was not to implement 41P. It was to eliminate the need for Form 5330.20 (Certification of Compliance) and add credit/debit processing for paper forms.

Not so fast.

Instructions 2g state that LEO Certification is for individual makers only.


Item 10 must be completed for an Individual maker.

Above that it also states fingerprints are only required for individuals as well.
