It appears that the fed's outlook is that medical marijuana patients may not have guns despite the fact that such patients are complying with state law. One article stated that a court of appeals has upheld the decision. Distinction was not made between purchasing and owning already purchased guns. Not related to this issue is another example of unclear or not well defined areas of law. Federal law considers a felony that's been adjudicated to be a conviction, as does the state of Texas when issuing CHLs. I know that local authorities have told adjudicated felons that they could own already purchasedfirearms, and my opinion is that they are receiving poor advice. Those with adjudicated family violence misdemeanors have been told the same thing. I say poor advice because when "caught" with guns by feds at a later date, this advice won't save them. My information comes from former students who received adjudicated sentences. One other source is a young, college educated woman who has been able to continue working in a professional role. She clearly has an adjudicated felony drug conviction and without concern continues to keep firearms in her house. They had been removed, though, during the probation period.
