I don't understand the qualified immunity part? The guy said he testified to his "opinion" as an expert witness. It seems that Arizona DPS and this guy disagreed to the Agency reporting procedures and he wanted to bring it up in court cases and eventually got fired over the disagreement. Kind of hard to determine if the employess was fired for his opinion or the insubordination from the 3rd hand account on the video. Just because the court said the supervisors involved don't have to individually pay for the law suit (the qualified immunity part) doesn't mean a case against the Arizona DPS for wrongful termination just goes away.

He didn't mention anything about the two pronged test and if the court established a constitutional right was violated. He just discussed the second prong about the clearly established right being violated. David

Kinda wondered about that too. He only sued the higher ups, not the tax payers, so it seems he may not be motivated by wanting a pay day.
