selling a handgun to a CA buyer

I know if you sell a handgun to a CA buyer it has to be on the approved list. Is that the sellers reponsibility, or the receiving FFL to ensure this?

Pistol is a SIG 226R Stainless in .40 S&W.

It does NEED to be on the approved list.

Per the CA DOJ, it is technically the receiving FFL's responsibility. However, unless you don't mind getting the gun shipped back to you within three days along with a demand for a refund I'd make sure the gun is on the list.

The buyer should know whethor or not it is on the list prior to attempting to purchase the gun. The only folks that are exempt from "the list" are peace officers.

Be sure you don't ship ASSEMBLED standard capacity magazines to either the receiving FFL or the buyer. The ffl will not be able to transfer the standard capacity magazines to the buyer, and the buyer is not legally allowed to import standard capacity magazines. Non-LEO are only allowed to RECEIVE retarded capacity magazines.

However, you can ship the magazines UNASSEMBLED to the buyer as repair parts...

That's the exact line item the buyer sent in his "I'll take it" e-mail. I called his FFL today and I'm confident of this transfer / sale / shipment. Thanks guys.
