the top rail on the handguards do not line up exactly with the top rails of the upper...i've taken the handguards off in an attempt to realign but its not working...thoughts...

If its not free floating then there will be a fair bit of play and inconsistency. Try using a carry handle to align if possible, but if theres no nut to tighten them in place then that will do no good.

That looks more or less like an NC Star four rail that was re-branded. I think you just got a lesson of "you get what you pay for". Assuming that the front sight, gas tube and barrel nut are properly aligned with the receiver, I would venture a guess that your four rail is jacked up.

If I were you, I would scrap it and save up for a rail of known quality (if you really need one). Heck, one of the heavy YHM free float rails would have run you about $110, and you would be in much better shape with it than you are right now. Even a Knight's Armament blemished drop in four rail runs $150, and you see better deals than that at gun shows and the equipment exchange.
