Somebody correct me if I'm wrong.

Legislative Branch-writes the laws , they sign them now without reading them

Executive Branch- enforces the law

Judicial Branch- upholds or strikes down the law based on the constitutionality of it.

Clearly what is needed here is a Law Czar who can look into this situation and make a legally binding determination.

California did the same thing with prop 187. The people voted for it, and the state refused to advocate for it.

i'd be OK with it, if he'd also instruct the ATF to stop enforcing the NFA and the GCA

both significantly more blatantly un-Constitutional than the DOMA, i should add.

He could have said:

1. The AG issued an opinion that the law is unconstitutional.

2. Pending a final decision by the S.Ct., the executive branch has suspended enforcement of the law.

3. But the Solicitor (or US Solicitor or Solicitor General or whatever he is called) will continue litigating the case through the Supreme Court to obtain the final decision referred to in #2 above.
