Retroactive recusals? That would destroy any credibility the court has, and they have been the most respected branch of government for a long time.


Remember the last time, under external pressure from Congress and FDR, SCOTUS voted FDR's way in several landmark cases including the National Firearms Act, Social Security Act, and several cases relating to New Deal issues. Prior to the 'War', SCOTUS had slapped down many parts of the New Deal laws and in turn FDR got Congress to start threatening to pack the court with new justices. If you didn't know there is no set number of justices, and Congress can actually add more. So SCOTUS gave in, and in 1937 started rubber stamping laws FDR and the Congress had signed including the ones I mentioned above. Now Congress is hinting of meddling with the court to affect the outcome of cases (ObamaCare is coming up next year), and talking about retroactive recusals is cases already finished.

Very dangerous stuff to the health of our Republic, and it still amazes me given everything FDR did to damage separation of powers and expand government he was elected 4 times.

Soooo, Mrs. Thomas' involvement a half a decade ago in a group that questions Obama-care is compared to Kaigen's involvement in the actual crafting of the law.

Yea, that sounds equivilent.
