So I have an AAC Evo 9 that I got 8 years ago. At the time I was a single college student so I did the CLEO/fingerprints thing and life was good. I recently purchased an SBR and put it in a trust including my wife's name. I want to put the EVO 9 on the HD pistol, but I'm concerned about possible charges if I were to go out of town and she needed to use it since it's only in my name on the form 4.

How valid is this concern?

Do I need to pony up another $200 to get it moved into the trust?

You have a reasonable concern in that you would be allowing someone access to an NFA item and you are not there.

The only option I know of is to transfer it to your current trust.

That's really the only option.

I would run the SBR in that role though... esp. if she is on the trust and I assume she is trained/familiarized.

I'm going through the same thing now that I have a Trust. It seems ridiculous to be able to store everything in the same safe, yet have to pay the gum'mint $200 to file a new form with a mere name change. :rolleyes:

But there's really no other way around it.

You know, I just really don't think I can stomach it. If I go out of town, the silencer comes off the gun and goes in the safe...simple as that.

Not much of a concern. But if it makes you sleep better, get a small GunVault style safe and store EVO in there and take key with you.

Yes, $200 more if you want to xfer it into ther trust.

Would the op have to wait another 6 months for the ATF to complete the transfer?

He has to wait whatever the current wait time is. (right now around 5 to 6 months) In the interim he still keeps possession of it on his form 4.

5 is tax exempt for to/from Govt, to lawful heir, etc.

or estate beneficiary

(i.e. you die, your heirs can take possession through a transfer at no charge)

Thank you. I know that is the form we have used for the PD. There is a bummer of a red stamp on the form stating the pre '86 MG is not transferable to us regular folks!
