This is what happens when every agency thinks it needs a SWAT team.

The way to avoid such mistakes is premission build up. The narc and a couple of team members do a drive by on the location, it would become obvious to the narc that the address is not the place either he or his CI did a drug buy. Problem solved.

But when you allow work load to do away with proper mission planning you end up shooting innocent people. The SWAT officers will claim operating in good faith, which the average citizen of the jury will buy because they don't know any better.

Qualified Immunity should stand up an until a police officer is convicted of a felony.

Someone said, "show me a 10 man PD and i will show you an 8 man SWAT team"

I read that there was far more to that story than the media has given us.

The warrant was executed on the correct house. The judge found PC that the house was connected to drug trafficking and there would be evidence of that in the house.

That alters the fact patterns for sure. When I was in MA, they went into the wrong house in Boston and an older gent (was also a pastor I recall) had a heart attack and died. I recall the city paid out big to his family.

Right. I haven't studied the issue, but logically it should be treated like self-defense. An aggressor normally loses the right to self-defense because he initiated the fight. Qualified immunity should be lost in cases like these where police go to the wrong address and intiate an attack that foreseeably leads to the occupant defending himself.

Any one here would have responded the same way.
