Thanks for the Info
Sorry GunGuy98 Got to me first But i will keep a look out for you .I think I can get a few from some Buddies of Mine I'll Try and help you out!!
Headed to the Post office !!!You should get them This week i hope:cool:
From what I gather unless you can prove the mag was manufactured on or before the date 13 Sept 94 you can't own it! So if the magazine is not marked as such -with a date of manufacture pre 13 Sept 94 it would be illegal!
Part NYS assualt weapons ban law:
23. "Large capacity ammunition feeding device" means a magazine, belt,
drum, feed strip, or similar device, manufactured after September
thirteenth, nineteen hundred ninety-four, that has a capacity of, or
that can be readily restored or converted to accept, more than ten
rounds of ammunition; provided, however, that such term does not include
an attached tubular device designed to accept, and capable of operating
only with, .22 caliber rimfire ammunition.
I have 3 Pre-ban Cooper Industry 30 rounders all are marked with DOM 030389! I also think there is other laws out there that stop the import of such as well! So you can't even buy them and have them sent to you!
Go to the post office and mail those things to friends and family out of state. Post Ban mags are classified as "high capacity feeding devices" and a class something something felony for EACH mag. if you have not placed your PMAG order, consider crossing them off your list:mad:
Fulton Armory has some pre-ban Orlites right now though:(
The state has to prove that magazines that are in your possession are illegal and any with an obvious date stamp after the ban are along with almost all of the new polymer mags. Around here most of the preban mags you see for sale are lacking the date stamps and markings. These mags less markings are considered to be pre ban.
Let me clarify this for you because I don’t think you understand the law in NY regarding high capacity magazines. Mere possession is a D Felony, doesn’t matter if it’s in a pre ban riffle or in a bag with no gun:
§ 265.00 Definitions. 23. "Large capacity ammunition feeding device" means a magazine, belt, drum, feed strip, or similar device, manufactured after September thirteenth, nineteen hundred ninety-four, that has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition; provided, however, that such term does not include
an attached tubular device designed to accept, and capable of operating only with, .22 caliber rim fire ammunition.
§ 265.02 Criminal possession of a weapon in the third degree.
A person is guilty of criminal possession of a weapon in the third degree when: (fast forward sub 8) such person possesses a large capacity ammunition feeding device.
Criminal possession of a weapon in the third degree is a class D
Felony.
Also no date means nothing, You either need a date on the mag prior to Sept 14, 1994 or a way to show its pre ban. Be carful with this stuff, conviction fo a felony means your not aloud to have a gun...
§ 265.01 Criminal possession of a weapon in the fourth degree.
A person is guilty of criminal possession of a weapon in the fourth degree when: (foward to sub 4) He possesses a rifle or shotgun and has been convicted of a felony or serious offense; (Criminal possession of a weapon in the fourth degree is a class A misdemeanor). Trust me on this, I know this section of the law in NY.
