I already have an SBR as a stated in my first post. I am not scared of the $200 tithe, or the paperwork. While an SBR would obviously be preferable, it will not work for this application, because I travel to a state where SBRs are unacceptable, but a 16" rifle is legal. That was my entire purpose behind this build.

And as for the gunsmith... I'm not naming any names. But he is someone who has been specializing in ARs for a while now, and is an AR manufacturer. He SHOULD have been as tried and true as they come. I know that he knows how to do it, I think he was just trying to put the minimum of effort into it. Which is enough to turn me off even more than someone who was just an honest-to-god hack.
Maybe a dumb question....but is under 16" a problem since the op has a documented SBR lower. Someone posted on, TFL or THR , within the past couple of days, a letter response from the ATF tech section from like 2001 that said multiple uppers were ok and were not a constructive possession issue as long as they were not assembled on a non registered lower, since there was a registered lower present. IANAL but the OP may be worrying about perm pinning a 14.5 that would be legit for him to posses as a 14.5 with his existing SBR lower.

It sounds to me like the AR smith should re-do the job correctly, and buy you a new barrel if that's what it takes to do it right.
Two stacked peel washers? That's pretty bad. What did he say when you picked it up from him? Does he stand by his work? Did he offer to fix it?
I recently timed a flash hider with a peel washer and had a little trouble. In trying to get the shims to de-laminate, I heated it up enough with a butane lighter that the shim stack came off of the base washer! And all the shims were still attached to each other! I was able to peel enough shims off, and then stack the remainder of the unpeeled shims on top of the base washer and get the hider timed. But as with your case, the base washer and the remaining stacked shims didn't line up perfectly. So I redid it with a new peel washer and got it right.
Is it possible that this is what happened in your case? Could it be just one peel washer base and a separated shim stack that don't line up? About half the peel washer is the solid base washer, so stacking two peel washers will be thicker than one "unpeeled" washer.
I say register it as a SBR and send it to Randall to get chopped to 10.3 inches.
