I imagine there are too many variables to know since each jurisdiction may do things differently. It can depend upon the leaning of the DA, the backlog of cases, or a hundred other factors.
I can tell you that in Florida the results can differ dramatically from one county to another. I work with two LEO's, each from their county agency and those counties border each other. Both get into obviously justifiable shootings. One gets his weapon back inside of 2 weeks. The other has to buy a new one because he got it back after 2 years. There were no factors involving the righteousness of either shoot.
Regarding the OP, use the best weapon that you have the most familiarity and training with. How much is your life or that of your loved ones worth?? Yes I use an SBR, with a can, and with electronic ear pro.
