    I was refering to a form 5320.20 for transport across state lines. The overall length must match the description of the registered SBR.

    Let's go back to IG's original question then. Can you cite the regulation that states that particular requirement? I ask because I can't find any such statement in the NFA handbook in reference to interstate transportation of an NFA firearm.

    I could not find the specific law, however, my examiner would not approve my form 5320.20 do to a descrepancy in over all length. It was registered as a 20in a2 rr but I had a 10.5 in upper on it. I actually notified the ATF about my barrel length change 2 years prior, but it didn't matter, I did not adjust the OAL.
    Long story short, the issue was resolved very quickly. I needed to send another statement of the upper change and new OAL, or travel with the 20in Colt A2 upper on the gun.
    I did not challange the request, I just did as told. The process was quick and my examiner emailed me my forms once approved so I could get going on my trip.
    Come to think of it, the ATF was not concerned with the barrel length, just the over all lenght.

    Are you asking whether or not you must notify ATF as to interstate transport of an SBR?

    You not only have to notify them via Form 5320.20, you have to get their written permission.

    From ATF publication 5300.4:

    (M21) Does the registered owner of a destructive device, machinegun, short-barreled shotgun, or short- barreled rifle need authorization to lawfully transport such items inter- state?

    Yes, unless the owner is a qualified dealer, manufacturer or importer, or a licensed collector transporting only curios or relics. Prior approval must be obtained, even if the move is tem- porary. Approval is requested by either submitting a letter containing all necessary information, or by submit- ting ATF Form 5320.20 to the Bureau of ATF, NFA Branch. Possession of the firearms also must comply with all State and local laws.

    Your post makes absolutely no sense at all. Why would you "register" a 20" rifle?

    Also, when I sent my request in, it was based upon the original Form 1.

    The form you cited is the "request to transport". In addition if you don't want the hassle then you just put a 16" upper on it and move along.

    It's a registered machine gun that is shorter that it was. The ATFE wanted it to match it's original description. They were very nice about it, but would not approve my 5320.20 until I corrected the over all length issue. I even had to send a picture with the rifle and a tape measure along side it. I know, sounds odd.
    The learning point is, even though you may or may not need to notify of any barrel length change, the gun needs to match the description on your form 4.

    I don't know what to tell you, but the person you spoke to was wrong. If you in fact had a "machine gun" then it doesn't matter what upper is on it, because the upper is irrelevant because the "full auto" status takes precedence.

    You can put any upper you want on a registered machine gun lower.
