Well we decided to go with a H buffer just to err on the safe side and make sure that it would certainly cycle the low powered .223 stuff. Turns out the previous owner DID have a carbine buffer in there.

Couldn't test fire it though, as I don't have my stamp and we couldn't "assemble" the rifle. However, when I finally do get to shoot it, and find out the H buffer will run remington pmc & green box okay, i can step it up to a H2 buffer and test from there-- i think that would be an easy swap. But at least for now, i KNOW what's on the gun. I can always experiment with an H2 buffer down the line...

You can put it on a lower as long as the stock isn't attached. It would essentially be an AR pistol and you would at least be able to function test it.

Would that not still be considered a sbr since it is still able to accept a stock and not a registered pistol lower?

In that case, I think I will buy a 12.5" upper and take the stock off when switching between uppers and then try to convince the police that it is legal because it is not the internet.

Personally I don't care what you do. If you can't understand what the law is or what the legal definition is of a rifle, AR pistol, SBR, etc.. that's on you.

I do know the law, seeing how I used to be in law enforcement, former FFL holder, and have a BS in criminology. Just trying to keep the OP from getting in trouble with LE by using your logic and manufacturing an illegal firearm and committing a felony. Maybe you need to brush up on the law or site your sources to where it would be legal.

This has been discussed numerous time. If you do not have a stock attached then it is not SBR.

There is no difference between an SBR and an AR pistol with the sole exception of having a stock attached.

If I put a short upper on a lower and do not attach a stock then it is not a rifle.

And before you cite "constructive possession or intent" save yourself the trouble.

Well, the way I understood it, is that it is only considered an AR pistol if it has a RE that is not capable of accepting a buttstock. Otherwise, a regular RE with the buttstock removed is still considered a rifle.

Though, i really have no clue and never looked into it that carefully, lol.
