I've seen crazy contracts upheld, but then again a bank/credit card company wasn't involved...I hope they uphold his contract and pay him the money.

I changed my warranty on my recent truck purchase. I told the guy, I'm going to write a few changes here...he said whatever(clearly not thinking that it mattered,) and now I have two more years and forty thousand extra miles of bumper to bumper coverage. It can even be in your own handwriting on a printed contract.

I've never met a lawyer in my life who signed a contract as it was presented...on anything. Renter's agreement, car sales, mortgage, or any of it. They genuinely feel like they're getting hung out to dry unless they amend it...and honestly if the worst case scenario happens they are. Those contracts aren't designed to protect both parties, they're designed to protect whomever paid a lawyer to craft it.

Much truth here. In real estate we change contracts constantly. It doesn't matter if most is typed and a part of it is hand written. If you sign it and accept it you are bound by it.
Tell my tale to those who ask. Tell it truly; the ill deeds along with the good, and let me be judged accordingly.

Some advise, initial and date each page of a contract. It helps to prevent someone swapping out pages later on.

Could only get away with that in a place like Russia.

imagine if all those fools who signed onto balloon mortgages and subprime lending agreements actually read that Truth in Lending statement!

My mother was an underwriter during the boom a few years back (while i was in college) and we always discussed the issue of buying a house. She used to warn against the balloon payment option, but both the broker and the buyer were hell bent on them! She used to joke about even bothering to include the Truth in Lending. When I bought my house last year, everything was read and signed,

Read every word of the docs when buying my first home. I will admit, I have become a lot less thorough over time simply because of the fact that I now work in finance and have a really solid understanding of the contracts we produce.

That said, things like this are why we always have our legal team go over everything before we sign on behalf of the company. One or two sentences being changed can be a huge difference.

If he signed a contract with his amended terms and they chose to issue him a line of credit based upon those terms, I can't say that they have much of a case for "fraud." He accepted a contract with amended terms and they chose to accept it as well. That said, when he was mailed the card, it would have come with a card agreement (at least it would have here in the states) stating repayment terms, interest, etc… One very important line in that agreement is that use of the card constitutes agreement to the terms in the document.

Could have only happened in Russia or similar places.

Never would get upheld here. Banks always win.

That is because Russia; the former home of Leninist/Marxism/Communism is far more open and Capitalistic then we are. Sure, their government is corrupt and crooked. But that government doesn't hide it and does not stop someone from achieving wealth through capitalism since those that do achieve wealth grease the palms of those in office.

While we continue down the failed path of Socialism and pretend that our government isn't corrupted. I'd rather be in a crooked state that allows me to achieve wealth and half to bride some low level functionary then deal with the shit here in the USA right now. I want to start another business but the current environment does not favor me trying and risking since I am not of the chosen class of scum sucking bilge rats and rotten crotch fruit.
