    PA - Supreme Court says no warrant needed.

    Pennsylvania police officers no longer need a warrant to search a citizen’s vehicle, according to a recent state Supreme Court opinion.
    The high court’s opinion, released Tuesday, is being called a drastic change in citizens’ rights and police powers.

    Previously, citizens could refuse an officer’s request to search a vehicle. In most cases, the officer would then need a warrant — signed by a judge — to conduct the search.

    That’s no longer the case, according to the opinion written by Supreme Court Justice Seamus McCaffery...

    Just from reading it briefly between calls, sounds like the ruling falls more in line with the way it works elsewhere in the country.

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    This is the way it's been done for years here in NC. Personally I think it is stupid for officers to have to get a warrant for vehicle searches when PC exists

    PC + Car = Search, nothing new here, except maybe dopers in PA who will have a few hard lessons to learn.

    Educate me...

    So I get pulled over for doing 65 (speeding ticket - fair enough) while in a 55 while visiting Amish country in Pa. - They say I need to search your car. I say no thank you sir, you have no PC, respectfully request to exercise my 4th amendment rights. What happens next?

    They search your car anyway. Just like they will do everywhere else in the country. Sorry, but the constitution don't apply a whole lot now days. It's just a list of suggestions written by a bunch of racist, greedy, dead white guys... Don't you know nothing. Thankfully most LEO have a better grasp of the constitution, have better things to do or both to go around bothering most folks for no reason. Obviously there are exceptions, but thankfully they are still not the rule. Best thing to do in General is keep the car clean and don't give anyone a reason to wonder. It sux, but life often does.

    I understand what's being said about PC and all, but that's a slippery slope to tread. I'm all for messin with dope heads, gang bangers, and all other dirtbags. But when it's easy to take away their rights, it makes me wonder how easy it will be to take away my rights.

    This continued erosion of liberty for the sake enhancing Public Safety (which is laughable in it its own right) is getting old..

    Just because something is the norm doesn't make it right either. You get pulled over the LEO smells dope then it sucks to be you but absent that or an additionally valid reason its just a fishing expedition..

    Why do people not care about this stuff? We may as well give full access to our cell phones too, oh wait....

    Again; youre wrong and please feel free to stow the wide brush that you're painting with. We've had the vehicle exemption in place here for as long as I've been in law enforcement and if we get shot down on consent (and we dont have PC) then we arent searching the vehicle.

    Thats a news flash for those of us actually involved in law enforcement. Last time I checked, it was in full effect and we have to abide by it all the time. Maybe it was on the last TPS report that came out that this no longer applies...after all that one did lack a cover sheet.
