    And you're simply asked...

There's no requirement to do so.

I have several that are now different caliber and/or length...and have never written them for anything. I fill out 5320.20 forms and list what's currently mounted, which is different than the specs on the F1, and they get approved no questions asked.

I think we all agree, if you have a SBR you could put on a different length upper on the same without running afoul of the law.
Does this also mean, you could put on a upper with a different caliber than the one you put down during the Form 1 process?

Sorry, I missed the (1). It was a Form 1.

Forget the question and look at the answer. Direct from the BATFE.

Q: May the short barrel on an SBR or SBS be replaced with a long barrel for hunting or other purposes, with the intent of replacing the short barrel?
Yes, and you will not be required to again register the firearm before replacing the short barrel. ATF recommends written notification to the NFA Branch when a firearm’s configuration is permanently changed or removed from the purview of the NFA.

Doesn't matter what caliber is on there.

BATFE only asks to be notified for permanent changes. Swapping an upper isn't a permanent change, and unless you've created an illegal configuration (practically impossible to do with an already registered SBR) it doesn't matter.

And it's still important to note that all they can do is ask. They're required to keep the registry accurate (which we know it's not), so they have to ask you to notify of "permanent" changes.

There is no corresponding statute or regulation that requires you to give them that info.

Then...you can get into the whole definition of "permanent" in the first place. The AR is a whole different platform than what was available in 1934. I can swap upper, sell barrels/uppers, etc...but none of that is truly permanent.

Which is why I posted what I did above. They recommend you notify them, but there is nothing that states YOU MUST.

I take a picture of myself holding the new upper and a copy of that day's newspaper. I also keep a copy of the pic in my safe and safe deposit box.
