    I'm not going to panic yet. The Heller case very clearly established that firearms "in common use" are protected by the Second Amendment. Since the AR15 is pretty close to being the most popular firearm in history, it's going to be hard to argue that it's not in common use.

    Secondly, all the SCOTUS has to do is refuse to hear any petition. That leaves the losers in this case screwed, but it protects the precedent set by Heller.

    I'm no lawyer but that's how I understand how all this works.

    Third, what happens in Maryland stays in Maryland for all I give a frack.

    The article mentions other states picking up on this.

    If Texas, New Mexico, Arizona, or any of a number of other states pick up on this, I will leave the country.

    I'm not going to panic yet.

    Well it is a good thing then that all my Stoners and Kalashnikovs are semi-automatic sporting rifles and not those dreaded baby killing selective fire assualt rifles with the shoulder thing that goes up.

    That's an activist judge butting heads against all precedent. Even the NY case agreed that the AR-15 was "in common use".

    If this gets any traction I would like to see TX, AZ, and NM secede and become allies. The entire Nazification of Germany was legal.

    It's YOUR country. Why simply leave it???
    I see this no different than saying "who cares if they steal from everyone else in my neighborhood... Now, if they start stealing from MY living room, and my bedroom, then I will just leave"

    Nothing against you personally Doc, just a phrase that I have a hard time wrapping my mind around.

    The Heller cases also concluded entire classes of weapons cannot be made illegal. When it goes to SCOTUS, it should be overturned.

    The handgun ban and the trigger-lock requirement (as applied to self-defense) violate the Second Amendment. The District’s total ban on handgun possession in the home amounts to a prohibition on an entire class of “arms” that Americans overwhelmingly choose for the lawful purpose of self-defense. Under any of the standards of scrutiny the Court has applied to enumerated constitutional rights, this prohibition – in the place where the importance of the lawful defense of self, family, and property is most acute – would fail constitutional muster. Similarly, the requirement that any lawful firearm in the home be disassembled or bound by a trigger lock makes it impossible for citizens to use arms for the core lawful purpose of self-defense and is hence unconstitutional. Because Heller conceded at oral argument that the D. C. licensing law is permissible if it is not enforced arbitrarily and capriciously, the Court assumes that a license will satisfy his prayer for relief and does not address the licensing requirement. Assuming he is not disqualified from exercising Second Amendment rights, the District must permit Heller to register his handgun and must issue him a license to carry it in the home.

    Agree on all accounts. I have put a lot of thought into it, and I don't think there is anywhere else to go.

    I'll just answer briefly so as not to hijack the thread:

    TX, AZ, and NM are some of the most gun-friendly states in the Union. In order for them to ban our favorite rifle these states and the rest of the country will be in a death spiral that is irreversible, and not just due to the gun issue. In other words, for those states to become "gun grabber" states that will be a bellweather that it's too late to save the country.
