    H.R.838 Threat Assessment, Prevention, and Safety ACT (TAPS)

    I'm surprised I haven't seen this posted here yet.

    From the same government that brought you the Patriot Act...

    H.R. 838 Threat Assessment, Prevention, and Safety Act (TAPS).

    Here's a small bit of text taken from the bill.


    "BEHAVIORAL THREAT ASSESSMENT AND MANAGEMENT.—The term “behavioral threat assessment and management” means the systematic and evidence-based process of—

    (A) identifying individuals who are exhibiting patterns of concerning behavior that indicate an interest, motive, intention, or capability of carrying out an act of violence;

    (B) investigating and gathering information from multiple sources to assess whether an individual described in subparagraph (A) poses a threat, based on articulable facts; and

    (C) the subsequent management of such a threat, if necessary."


    Also,

    "Not later than 30 days after the date of enactment of this Act, the Secretary shall establish within the Department of Homeland Security a Joint Behavioral Threat Assessment and Management Task Force (referred to in this Act as the “Task Force”)."

    Continued,

    "It shall be the duty of the Task Force to provide recommendations to the appropriate committees of Congress and the Secretary on the development and implementation of a national strategy for preventing targeted violence through behavioral threat assessment and management (referred to in this Act as the “national strategy”)."

    Of course that's not all..

    "RULES AND PROCEDURES.—Any member of the Task Force may propose to develop or change existing operating rules and procedures of the Task Force consistent with the functions of the Task Force. Any change to such operating rules and procedures shall be adopted upon a majority vote of the Task Force."



    So it appears both Republicans and Democrats, in a bipartisan effort for once in the past three years, want to make a task force designed to find anyone they deem a threat, or capable of being a threat (we can only guess what that means). Then, once they create this task force (comprised of only constitution following members I'm sure), they will allow them the ability to change the rules by a simple majority vote (13 out of 24 votes).

    Maybe I'm missing something here, but what the hell?

    Has anyone else seen this? What are your thoughts?

    Section A is some pretty ambiguous and dangerous verbiage. Literally anyone and everyone could be articulated to fall under that definition. Seriously.

    Isn't just about every single person "capable" of carrying out an act of violence? Didn't the boston bombers pretty much drive that point all the way home? I mean when a couple flunkies with pressure cookers and nails can attack a major event haven't we conclusively proven that anyone has the capability no matter who they are?

    Somewhere AOC is in close proximity to a bottle of alcohol and a cloth rag. She has everything she needs to construct a molotov cocktail and inflict serious damage on any gathering of people and certainly rational thought isn't going to keep her from engaging in such acts.

    Agreed.

    Sadly I have no doubt this will fly through the house, and likely pass the senate as well. If it indeed makes it that far, I find it very hard to believe Trump wouldn't put his stamp of approval on it.

    If I was a betting man, I'd almost guarantee roughly a week or two before this bill gets to congress we'll see some form of mass shooting event. They do seem to always happen at just the right time, after all.

    Between Brian Babin (R-TX, Sponsor), Dan Crenshaw (R-TX), and Gary Palmer (R-AL) all on board for this bill, and a number of Dems lining up with support, I find the odds of this passing uncomfortably high. With Republicans like these, who needs Democrats?

    Well a republican president with a GOP majority congress passed the Patriot Act and that was the first step of the "really, really bad idea" road to our current situation. So here we are, and with Trump we have even fewer guarantees. The only thing we know for certain is both parties will really, really enjoy this new tool so that they can randomly declare virtually anyone to be a "threat" and presto that person becomes subject to the new legislation even though they haven't actually done anything wrong.

    Our laws are no longer about consequences for actions, now they are about simply meeting a set of criteria which is often vague, random and frequently meaningless in terms of actually preventing actions.
