You might check the archives of the old Home Gunsmith/Roderus Custom forum, it might still be there. Celata cautions anyone who visits his website that he assumes he's under constant ATF surveillance.

Since when does historical law matter? I got 3k years worth of law that marriage is between a man and a woman. Hell, it even sets historical presidence.
Control the language and you control the law, regardless of how said law is wrote.

The ATF declared an AR-15 lower to be the receiver decades ago. This was an error made by the ATF that led into this court case. The upper should have been declared the receiver 60 years ago by the letter of the law. SIG550, FNC, etc have the upper as the receiver.

If this court case was allowed to proceed and a ruling issued that a lower is not a firearm; then the new regulation would be that both the upper and lower must be serial numbered matched together and can never be separated.

This was not going to turn out in our favor.

The judge was not on our side. AR-15 receivers were not going to be magically declared non-firearms.

This would also affect basically every semi auto pistol; as a pistol frame, when viewed with that interpretation, also does not meet the definition of a firearm receiver.

Any modern military rifle HK, SIG55X, FAL, SCAR, AUG, etc would also fall under this rule.

When this law was written, modern assault rifles with two receiver halves were not foreseen by the people who wrote the law.

I’m glad someone else read this and thought, “Not good for gun owners.”

Agreed. Scottyryan's post is definitely the most informative and well reasoned in the thread.

ATF may be dropped the case to avoid undoing years of their own regulations, but in doing so they did gun owners (and the industry as a whole) a huge favor.
