    5320.23 Adding Trustee to Trust

    I'm a bit confused on this form. I want to add 2 "Responsible Persons" to my NFA Trust. From reading the form 5320.23, it looks as if I need to file one for each of my NFA (suppressor & SBR) items for each RP that would be added as a trustee. Do I have this correct? Do I need to attach copies of the corresponding stamp to the submitted 5320.23? Thanks for any assistance.

    No.

    Adding and removing RP’s has nothing to do with the ATF until you submit another Form for approval.

    This.

    They will be informed out the next time you add another item. If you add or remove trustees in the meantime, it is not their business.

    Do they even need to be on the trust then? Kids come over and shoot. We swap lowers, rifles, SBRs, suppressors, etc. All day long. Build complete new SBRs.... blah, blah, blah.

    I only add additional people if they will possess my NFA items without me being around. For example when I visit my Father in another state, I may leave my guns with him while hitting the casinos (he has no interest). Keeps us legal, but pragmatically it's stupid.

    No one needs to be on a trust if they will not have access to the NFA items when not in your presence.

    Regarding the rest, I will assume that you actually meant that you do not actually build new SBR’s but simply put other short barreled uppers on your registered SBR lower(s), since “building completely new SBR’s” would be very illegal and certainly not something you’d post on a public, well-known forum without using a VPN.

    Correct. All the lowers circulating at our house that swap short uppers are definitely registered SBRs. Last weekend my son built his new SBR, a 6" 300BO with big can (double stamped) on my back porch. All the NFA hardware was properly stamped and at no time did a short upper get put on a lower that was not registered properly. We were testing one of my Sigs that has issues and at one time I did a 16" Saint Edge gas gun for an experiment. I may have worded something wrong in the above post. Sorry.

    So the bottom line is no need to have folks on the trust as trustees or RP if I'm present with the NFA item?
