You know that if it went to SCOTUS, that Robert would Rule not to allow the seating with a VP tie breaker.
The Second Amendment ACKNOWLEDGES our right to own and bear arms that are in common use that can be used for lawful purposes. The arms can be restricted ONLY if subject to historical analogue from the founding era or is dangerous (unsafe) AND unusual.
It's that simple.
Then technically, any Cabinet appointment made by a POTUS which ends up with the VP breaking the tie was ineligible as well. He's interpreting it to fit his own needs.
I'm not sure I follow his reasoning that Article 1 can't impact Article 2. It specifically states in Article 1:
Basically, it implies the VP can vote to confirm appointments regardless. Also, it doesn't say in Article 2 there can't be a tie. It says "consent" of the Senate of which the VP is a Senate member and only has that vote in tied cases.The Vice President of the United States shall be President of the Senate, but shall have no Vote, unless they be equally divided.

It sounds like that this likely won't be an issue anyway. The author of the article seems to think that the Dems can intimidate the GOP senators in close races into forcing a tie or rejection of nomination, but I think by this point, it's become clear that anyone who is against appointing a judge wasn't going to vote Republican anyway. So joining the Dems isn't going to help any of those senators and everybody knows it.
