TommyBuilt T36 are now machine guns

I also posted in NFA section, but if you don't check that area you will miss this notice. Very serious precedent being set here. They used a hammer to beat in a part then called it a machine gun.

I'm glad I didn't purchase one. I'd be pretty chapped having to pay for another receiver. I'm curious if Tommy Built submitted a sample to the ATF that was approved and the ATF later changed their mind. Or, did they just build and the ATF later said no. If it was the former, then I can understand Tommy Built having customers pay for the replacement receivers. If it was the latter, then Tommy Built should foot the bills.

At least he's only charging $25 for those of us who had it registered. I am bummed because I also had it cerakoted. Mailing it back seems very iffy to me, how do I drop an NFA item in the mail????? Normally isn't there a transfer process????

You can ship an NFA item for repair without notifying the ATF. Keep in mind that your SBR is the rifle as a whole, not just the receiver. If you send it and it comes back with a model number and/or serial number that doesn't match, then your form will be incorrect. So that's not going to be allowed. I'm thinking that some sort of transfer does have to happen, but I'm not sure. Tommy Built and/or the ATF definitely need to provide some more guidance. I wouldn't move until they do.

If you’ve registered your firearm as a machine gun or SBR, when you send your firearm to TommyBuilt Tactical for the upgrade, send the NFA branch a letter to remove your T36, serial # xxx-xxxxxx, from the NFRTR. Inform them your T36, serial # xxx-xxxxxx, has been recalled and will be replaced with a new GCA firearm. If you have any questions contact the ATF Baltimore field office.

Remove the stock before shipping and ONLY ship the receiver and lower to TommyBuilt Tactical. You may leave the barrel installed if you do not have tool to remove it.

Please send a copy of your APPROVED form 1 along with the T36 receiver.

If you plan to register your upgraded TG36 as and NFA item please include the following for engraving:
    Name or Trust Name
    City and State

ONLY send the stripped bare receiver or barreled upper, and the lower (DO NOT ship all parts or your complete firearm to TommyBuilt Tactical) If you absolutely do not have the means to remove the stock or brace you may leave it on.

Our preferred method of shipping is USPS priority large flat rate boardgame box. This box is available free at the Post office or you can request online that they deliver one to your home. The SKU is GB_FRB for this box.

Is it no longer a complete firearm because the bolt carrier is stripped?

Here's a good shipping guide. Note that the general topic is machineguns, but it talks about various types of firearms.

Unsurprising, back in the early 2000s when they tried to go after 80-percenter Rick Celata at KT Ordnance they broke the disconnector attached to one of his 80% 1911 frames that they assembled and tried to say "the 1911 is a machine gun."

Remember all the swag they had printed with "Always Think Forfeiture"? Shoulda been printed "Asshats Terrorists & Fascists"...
