New York Public Defenders Ask Supreme Court to Invalidate CCW Prohibition!

Wow, if these kinds of things still matter this is "kind of a big deal".

Several New York City area Public Defense organizations have filed an Amicus brief in the pending case attempting to invalidate NY's prohibition on carrying guns. The brief lays out SEVERAL INSTANCES where people who defended themselves- exercised their Civil Rights, and were prosecuted for simply defending themselves. Most Public Defender organizations in my experience have been fairly liberal, for them to come out and get behind this is pretty important if you are looking at the socio/political aspects of the case.

Now, this court has shown it will only rule on very narrow grounds, so this is probably meaningless to everyone but the residents of 8 shithole states that treat their citizens like convicts, but we'll take what we can get.

Thanks for posting that. It will be interesting to see how the court rules and what, if any, far-reaching results it has. Not holding my breath though...

My understanding of NY law was that in order to buy a guy you need a CCW but they restrict it for "to and from the range"

If that's the case then it is possible that this case won't effect "real" CCW simply allow the guy to get his restricted one and buy a pistol?

I think the case will be more broadly decided than that. They are, in my opinion, going to say that New Yorks system is so restrictive as to be an infringement.

They will have to issue some sort of guidance as to the contours of the right- "You MUST give people permits but you can restrict as follows..." blah, blah......

I would suspect that things like background checks will be ok, proficiency standards ok, certain places off limits to carry- ok.....BUT, they are going to have to go to a "shall issue" model in which average citizens, who meet the criteria will be able to apply and get a permit to carry in most places where they live, circulate around in public and work.

Never underestimate Roberts' capacity for f***ery, especially with his two new assremora sidekicks Kav and ACB.

Right now SCOTUS breaks down into three basic factions:
    1. The Hard Left - Breyer, Kagan, Sotomayor
    2. The Semi-Solid Right - Thomas and Alito, backed most of the time by Gorsuch
    3. The Establishment Crapweasels - Roberts, Kavanaugh, Coney Barrett, sometimes joined by Gorsuch

Call it a 3-3.25-2.75 split. I suspect Thomas was a deciding vote against taking the 2020 election cases because of KNOWING mischief would ensue, ditto how a lot of 2A cases have been spiked the past few years.
