Still fighting with the Bureau for not getting the vaccine, been forced to test every 72 hours, have to wear mask at all times unless eating or drinking. Whole office has to wear mask when moving about or anytime not sitting at desk away from others but I hadn't been doing that. Then was threatened with disciplinary action, written up for insubordination if I continued. So I am wearing the mask. Talked with the SAC today looking to see why only the unvaccinated are required to test when CDC's own site acknowledges that the vaccinated can carry the virus as well.

A brief summary from the article:

In an order issued Nov. 12 in Doe et al. v. Austin, U.S. Federal District Judge Allen Winsor of the U.S. District Court for the Northern District of Florida denied a preliminary injunction requested by 16 service members against the U.S. Military’s COVID vaccine mandate. A hearing is scheduled for Sept. 14, 2022.

However, the judge’s acknowledgment that “the DOD cannot mandate vaccines that only have an EUA” is significant for two reasons.

One reason pertains to the difference in ingredients and manufacturing process between Pfizer’s EUA vaccine and the approved Comirnaty vaccine, and the other pertains to the legal difference between a fully licensed vaccine and an EUA vaccine.

The plaintiffs lost in this hearing, but the decision is very detailed and is very skeptical on the DOD's claim that EUA Pfizer is equivalent to FDA-approved Comirnaty. It states that they are not legally equivalent, that the FDA has conceded this point, and explains material differences in both chemistry and quality control between them. The judge questions whether Comirnaty actually exists in the real world, and you could view this loss as on " a mere technicality." Detailed discussion of this point starts on page 13 of the PDF opinion. However, after three pages that seem entirely favorable to plaintiffs, on page 16 the Judge suddenly concludes that the plaintiffs aren't likely to succeed on this, stating:

no plaintiff claims he or she was specifically denied a BLA-compliant dose or offered only a dose from a non-BLA-compliant vial. Because the plaintiffs have not shown they are (or will be) required to receive an EUA-labeled, non-BLA compliant vaccine, the plaintiffs have not shown a likelihood of success

This could be setting the stage for an amended pleading and second hearing, but I'm not following this case enough to know if that's likely at this point.

If you're outside of that specific lawsuit but ready to make your own challenge, it appears there is a roadmap there to fighting any requirement to take an EUA vaccine. Of course, if properly labeled, FDA-approved Comirnaty actually shows up in the real world, your challenge might then fail.
