IIRC, if you have the misfortune to be targeted by a complete malicious jackass even simple "raised voice" can be arrested and charged as Misdemeanor DV.

When I was working at the school board, I was the guy who did background checks on all new hires. Local and FBI check (complete with fingerprint card). One day a guy comes in and with his application is a court ordered letter from his ex that explained that prior to their divorce she made false allegations of abuse in order to gain a more favorable settlement. In his case she actually got caught faking evidence and coaching kids which is why the judge acquitted him of charges and ordered her to write the letter.

And even with that, the arrest for DV still popped because that NEVER is removed from your arrest record, it's up to you to provide the court disposition. And even though this guy beat the odds and had a ex who actually got CAUGHT and he was completely exonerated, during the board review of his application several female board members expressed the opinion that "where there is smoke there is fire" and "he probably just got away with it."

You can literally do nothing wrong and allegations of DV can ruin your life, get your arrested and follow you forever. It is one of the MOST bullshit laws we've ever passed in this country. You can lose your rights even without a conviction. There isn't a cop alive who hasn't seen somebody get jammed up on a DV arrest simply on the word of the complainant.

The rest is dubious at best. Seems to devolve a lot of the issues to states, and you can guess that the bluest-blue states will use the money to make things worse with blatantly unconstitutional red flag laws, and the red states will either pass, or maybe, hopefully, do something useful.

Nowhere near as bad as what it could have been, of course.

After the SCOTUS decision all the state junk that exists now or is about to be added should be relatively easier to challenge in court.

I never agreed with the Lautenburg amendment. I was in Va. and the shall arrest with domestics caused more problems than is solved. Blatant lies, fabricated statements, and individual officers reluctant to make a decision flooded the court with cases that most always were dismissed. Of course the administration's directives were to arrest if one looked cross eyed to another, my job was to sort through that and tell the guys no. Of course we had shall arrest because people didn't do their jobs when they really should have.

I'm glad folks can have an avenue to have it corrected.

The problem with Red Flag Laws are it ripe for abuse from those who have an agenda. The intent or spirit of the law may sound good, but what was/is the intent of the drafter, the police, the "concerned" friends, family or other authorities (doctors, courts, med health workers)? If bias is present or the true intent is to take away rights unwarranted, then we have abuse. Their should be layers of checks in the system to help with this.

Problems with "new laws" is there are laws already in place to address it all. The whole domestic assault--I'm certain as Va. had an assault code and a state law requiring a report be filed for a crime, existed well before a new code for domestic assault. More shit piled on for no real reason.
