A preliminary injunction was granted by the 5th Circuit today temporarily blocking the ATF's pistol brace rule. This is actually a much bigger deal than it may seem. Preliminary injunctions are granted only in cases where the plaintiff would suffer irreparable harm if not granted, AND in which the Plaintiff is seen by the court as being likely to win the case on its merits.

Threat of imprisonment is a pretty high up there on suffering irreparable harm.

My understanding is it's ONLY for plaintiff Mock(?). FPC has a followup query to the Court about whether it also appleis to FPC members in 5C or FPC nationwide. My bet is even if so, having an FPC card isn't gonna stop Jackboot First Questions Never...

I almost wonder if SCOTUS passed on the Illinios?Naperville AWB (and it probably should have based on law and precedent- at this time) so that they can do something here with out seeming to be ‘gun crazy’. That’s the kind of BS that Roberts pushes. Let’s say the ATF appeals (to SCOTUS) and it goes to Alito, could he make it nationwide?

My guess is that ATF leaves this alone, at least until after the 31st, and tries to ‘clean up’ the 5th later. That SCOTUS is looking for Chevron deference closely, and the gun decisions, there is about three paths to kill this- and maybe take a swipe/bite out of the NFA…

Looks like will extend to GOA /Gun Owners of America members too very soon. And this is yet another reason to join these groups but I would hope the rest of the populace will enjoy the same before the 1st of June.

Video I saw earlier made the point that the ATF may have painted itself into a corner with the backlash that's happening with this and other cases. Also, big EPA smackdown in a 9-0 decision by the SCOTUS bodes well as an analogy to what the ATF is attempting.
