Call your local atf office and tell them. They are supposed to get it out of there possession asap after approval.

What a strange situation to be in. I agree with others here. I would start by contacting the ATF for guidance and then go from there.

On a side note, the fact that he refuses to give you what's yours only reinforces the validity of that negative review.

I would alert the ATF and see what they say. If I got nowhere with that I would poke around for a solid NFA lawyer in your area and see what they say.

Pretty sure he can decline to complete the transaction, which leaves you in limbo to find another FFL/SOT. Your money was probably for the NFA transfer which is done and likely will not be refunded. But he is in no way required to do the 4473, in fact ATF regularly encourages FFLs to not complete 4473 transactions that they don't feel 100% about.

Seems like he's indicated that he wants you to find another FFL/SOT to handle the transaction and it will Form 3 from him to that dealer. Then it will be up to that dealer to charge whatever they charge. Also sounds like he isn't interested in discussing it with you and he might get offended by any attempt to "negotiate" yourself out of this mess. When people use phrases like "those are his terms" that usually isn't a signal that he left you a window open.

I would simply get on a FFL/SOT network and find somebody who will complete the transaction for you and move forward with your life.

You got him, he got you, time to be grown ups. You are in AZ, there are literally dozens and dozens of FFL/SOTs around you, pick one.

Hilarious, all he has to say is he didn't feel comfortable about the transaction. At that point ATF will be as likely to look at the buyer.

Would he be able to Form 3 a silencer that's already been Form 4'd to the buyer?

The SOT said he would void the Form 4, so if he does that, he should be able to Form 3 it to another SOT who would then have to Form 4 it to the OP.

Probably the most painless way to reconcile this fiasco. The people who are suggesting he invite ATF into their lives or contact a lawyer have clearly not done either before.

Somewhere in his zip code with be a FFL / SOT who can probably handle the Form 4 for $50. I don't know why anyone would want to make things any harder than that.

And for everyone else, I know NFA things are pretty standard fare on this forum, but at the same time it's not something to play games with. It's still a federally regulated item and while it shouldn't be any harder than buying a gallon of milk, ATF would love nothing more than the opportunity to screw over a buyer or seller of such an item, they really don't care which if they think they have found impropriety.

When it comes to stuff like this, you want a FFL/SOT that you TRUST and you want to use that guy for everything.

This situation isn't right, but damn that's a rookie move.

Agree 100%. And I only do transfers with them, no other business. Keeps things easy and clean.
