Thread: The ATF is knocking on your door

    A buddy of mine just lost his father in law to suicide after he received a visit from the IRS and SWAT team. They were looking at him for tax law violations and also multiple gun purchases up to 30 in 1 year. He had been giving guns to family members as gifts. I am sure they were investigating "straw purchases" as well. He was not arrested and left at home. His daughter, my buddy's wife, found him the next day. When he went over to the house to help go through the belongings, he found the basement to be a fully stocked prepper stash. He had no idea it was going on. The guy was a well off lawyer. They donated the food to a food bank. I guess he didn't want to face the government coming down on him and possible prison time.

    Thats pretty messed up but i can understand how the FIL must have felt.
    I tried to follow the science but it simply was not there. I then followed the money, thats where i found the science.

    Too bad he didn't know the law. If they were purchased as "gifts" he was the "actual buyer" and it would not be a straw purchase. The only way it would have been illegal is if he gifted a firearm to a prohibited person. But buying a firearm as a gift is NOT the same as making a purchase FOR a prohibited person.

    That is why I have hated the straw purchase thing all along, it just confuses people. The previous law stated you cannot purchase for, loan or give a firearm to a prohibited person. It covered everything. There were lots and lots of times a person new to firearms would want somebody more knowledgeable to help them make their first purchases and that became one of the "warning signs" ATF identified as a possible straw purchase. So I watched people getting refused at big box gun stores simply because a female was attempting to buy a firearm pointed out by the male she had with her.

    Then the whole "actual buyer" thing was added to 4473s and that freaked everyone out because most people thought it meant all kinds of other things. I knew one guy who was convinced that once you were "on record as the actual buyer" you could never resell that firearm or give it to anyone until you died."

    Sad part is if they want one they will get one, "probable cause" be damned; the [mostly] corrupt judges will rubberstamp that warrant. I assume they will also watch you and your premises 24/7 until said warrant is approved.
