Looks like there have been two updates to this story.
1. The illegals drowned before Border Patrol was notified of their existence by Mexican officials. Texas had nothing to do with them drowning.

Three migrants attempting to enter the United States Friday night had already drowned when Texas’s National Guard turned U.S. Border Patrol Agents away from the Rio Grande, according to a recent Department of Justice filing.
Robert Danley, lead U.S. Customs and Border Protection field agent for the broader Del Rio area, wrote in a statement included with the filing that a Mexican official notified the U.S. Friday night that three migrants — a woman and two children — had drowned roughly an hour earlier while traversing the river.
A Border Patrol official then went to the Shelby Park Boat Ramp entrance, where three Texas guardsmen told him they had been ordered not to let Border Patrol agents into the area.
The filing contradicts earlier mainstream reporting and statements made by Representative Henry Cuellar (D., Texas), as well as a cease-and-desist letter to Texas attorney general Ken Paxton written by U.S. Department of Homeland Security general counsel Jonathan Meyer ordering Texas to stop preventing Border Patrol officials from accessing a section of the state’s border with Mexico.
“Texas’s failure to provide access to the border persists even in instances of imminent danger to life and safety,” Meyer wrote, referencing the drownings. “Texas has demonstrated that even in the most exigent circumstances, it will not allow Border Patrol access to the border to conduct law enforcement and emergency response activities.”
2. The Federales have put a deadline in place for Texas to withdraw. Or else. That deadline is today. Wonder what happens next?

A strongly worded letter from the Department of Homeland Security to the State of Texas demands access to the U.S.-Mexico border on land seized by the State in Eagle Pass. DHS officials ordered the State to cease and desist its efforts to block Border Patrol’s access in and around Shelby Park “and remove all barriers to access” by the end of the day on January 17.
Texas’s actions are clearly unconstitutional and are actively disrupting the federal government’s operations,” DHS General Counsel Jonathan E. Meyer wrote in a letter to Texas Attorney General Ken Paxton. “We demand that Texas cease and desist its efforts to block Border Patrol’s access in and around the Shelby Park area and remove all barriers to access in the Shelby Park area.” The counsel sets a deadline of the end of the day on January 17.
“The recent actions by the State of Texas have impeded (emphasis added) operations of the Border Patrol. Those actions conflict with the authority and duties of Border Patrol under federal law and are preempted under the Supremacy Clause of the Constitution,” Meyer stated.
The use of the word “impeded” by the DHS general counsel could imply a threat of criminal action against officers and agents of the State of Texas who are carrying out the orders of Governor Abbott to secure Shelby Park and prevent Border Patrol’s entry to the area.
