    Found it !!

    Ok today while going through some boxes in my garage I found my 10.5" Barrel that I acquired while in 1 SFG (A), it has the front sight tree on it. Now here are a few questions the barrel is older my guess mid 80's it looks fine chamber and grooves, there is no rust at all that I see. I would like to build an SBR upper with it for one of my M4s. Now to just build it and have it I dont need a tax stamp correct? I just need the stamp before I mount it on a lower, correct?

    Is the NFA process something I could do while I was deployed by internet or mail? I am leaving in less than two months and don't have time prior to going.

    Last question, more of a poll but here goes. If you were me would you A) make it into a MK18 looking upper leaving the sight tree on. Or would you B) take off the Front sight tree, put a low pro gas block on, and a 9" tube leaving only the flash suppressor exposed?

    If I were in your situation, I'd:

    1. Do a trust if you can in your state. You could have the papers in the mail in a day or two.

    2. You can build the upper, but you obviously can't put it on a lower until you have your approval.

    3. don't mess with the FSB.

    First, forget the word acquire. That could be bad. We all enjoy the perks of being in group.

    Per the question about the FSB: keep it the way it is.

    so in keeping with your comments so far on maintaining the FSB the I should go something like the top picture as opposed to the bottom one?

    I think possessing a short barrel or short barreled upper and an AR before you have a tax stamp could be construed as constructive possession. Of course you could build and store it at another location where there are no AR15s

    No NO NO. it is not constructive possession to have a less than 16" upper. A upper by itself is not legal or illegal. It is simply an upper it could be a pistol it could be a SBR, but until it is mounted it is nothing more than an upper. Lets use your line of thinking and apply it to say a firing pin for an AR. Could you be charged with constructive possession of a machinegun or SBR? Could could I be charged with constructive possession of a concealed weapon just because I own a handgun that I could carry concealed?

    As I stated before there all to many conspiracy therist and fear mongerers here.

    Indeed. A short barrel or upper half can be held for resale or future build.

    Constructive intent is for those nuts who saw that movie where people get prosecuted for crimes they'll commit in the future.

    Know that possession of any 1 machine gun part(m16)without a registered lower is constructive possession of a machine gun per BATF.


    A short barreled upper and a non registered lower is constructive possession of a SBR.

    Ok so with that school of thought I should just buy all the stuff and keep it as parts in a box until the NFA stuff is sorted?
