    It says no Colt AR-15. Which is one of the reasons we have sporters, sporter II, match target, tactical carbine, law enforcement carbine. ETC

    ETA: I apologize for crapping in your thread OP. I'd prefer you get the proper information so you can make informed decisions and build a top quality carbine within the confines of the law.

    ETA: There is no such thing as ATF rules for the NYS assualt weapon ban. The regs in the ATF book are just state laws compiled into one resource. Granted they were at one time the same thing as the federal ban, but that ban subsequently sunset, they are NYS law now.
    your missing the point. ATF still investigates even at the state level illegal guns because the AWB laws are Federal. that's why ATF has a office in NY which is less than a hour away from where I live. now, I don't know if it has to do with a agreement with the state police departments, but they do investigate, and if you get caught it's still considered a federal crime. I bought my KAC SR-15 from out of state and had to have it made compliant before it came into NY. you don't think that will be investigated by ATF? they know a stock SR is not NY compliant. they will most likely call who I bought it from and if they are not satisfied with that conversation they will come visit me personally. who knows when they will get to it, but eventually it will happen. and getting back to the point of helping the topic starter on getting a AR, if it's on a shelf in a NY store it has got to be legal, I doubt any FFL holder would risk their lively hood over a illegal gun. and if you get it out of state, just make sure its legal when you get it. you can always have the gun shipped in pieces and as long as its legal when the police or ATF come to check it your good to go.

    The NYS AWB laws are NOT federal laws. They MIRROR a federal ban that no longer exists! Enforcement is the jurisdiction of the New York State Police, not the ATF.

    You are correct it is a STATE law not Federal... hkhunter, The ATF does not need to check your AR.. You just need to take it to a gunsmith that can get rid of the "evil" AWB features if you bought it out of state, ect. Lets stop confusing the dude who made this thread!!

    I hear what you're saying, but I just got off the phone with the police department and this came right out of the mouth of the officer in charge at the weapons department. this is what he said, when I purchase a gun that falls under the AWB, when they run it through the FBI, it gets red flagged and sent to ATF. if it's only one gun, ATF is not going to waste their time with it. they may contact the local police, but most likely no. now if I buy a dozen guns that fall under AWB, they are coming to get me. now, if I get pulled over by local police and they find a illegal gun, not only do they charge me with possession of a illegal weapon, he said they have to notify ATF and I get charged Federally with possession of a illegal firearm. then I said even though the AWB is not federal law anymore? he said yes, because it's still falls in ATF jurisdiction because the state held the right to keep the ban in place. I'm just telling you what he told me. the way I see it, I really don't care because I'm moving to Texas

    Unless someone can convince me otherwise this one is locked. There has been plenty of advice given to the OP as to how he should proceed.

    hkhunter- If what you have said is true, then no dealer in NYS would even have the weapons in question as they would have already been shut down. Not to mention that no wholesaler would ship the weapons to them to begin with. All the OP needs to do is go to some local stores and see what they are selling. He can then determine what he needs to do.

    There are still lots of options available to him just like there is for the folks behind enemy lines in MA and California.
