Soooo..... all your SBR's are registered right?
Right?
I'm not sure that the poster has legally registered SBRs yet, but I could be wrong.
This is another question, which may be basic, once you legally register an SBR can the ATF come and inspect it any time without any notification?
Anyone have a line on getting oneself educated in these so called "rights" that we in the wonderful land of the United States of AmeriKKKa have?
I'm sick of either getting put in cuff's for no "real" reason or my car getting searched, or having a warrants search run on me, while I agree to "wait" in the back of the squad car, meanwhile all whole world watching this...
I mean this happened to be 2 weeks ago.. car getting searched and cop's talkin to me, i'm on my way to a job interview.. and when I finally show up to the place.. I realize my interviewer is the lady that was walking past me and the officers ten minutes ago... OBVIOUSLY I didn't get the job..
and the last time I told the officers I did NOT consent to a voluntary search of my car(my weak attempt at exercising my rights).. I found my self in the back of the squad car in CUFF's.. and being charged with obstruction of an officer, which after court was reduced to disorderly contact.. and my car STILL GOT searched..and I got fined $250...
That was an UGLY case.. all because I asked an officer to let me drive 10FT into my downtown apartment complex's driveway, during a parade... NEVER mind that I lived there or the fact the parade was over, or had passed thru my section 30 min's ago...The driveway was even BEFORE the street closed section.. such B.S.
I can't tell you how many times officers have taken my license away, stating I can pick it up at the station later... or that it would be mailed out to me..
I never get it back in the mail and the 2 times I tried going down to the station to get it.. I was pretty much looked at like a retard, "like what are you talking about, picking up your license, we don't or wouldn't have that here"..
NO CLUE as TO WHY THEY WOULD DO THAT???? anyone...????
NONETHELESS WHAT DO YOU DO IN A CASE LIKE THAT?
I need American Rights 101 or something.. or some way to brush up on "my rights"
THose are just the one's off the top of my head... I could write a whole book on this stuff.. and needless to say, I'm one of the good guys from my neighborhood... made it past the ripe old age of 21 and doing good..
put it like this.. I can legally own.. no problem..
peace and god bless

Technically speaking, if you say, "you can come check X", they are limited to "X", and anything they see from the door to "X". If they suddenly decide to go into some other room or open a closet or something, then that's a no-go. This is a simplification, and acting in good faith or bad faith plays into some of the what-ifs.
In practice, however, you probably don't want to even go there.
This sort of thing is where you get the "use the bathroom" or "get a glass of water" trick - no warrant? No problem, just ask to use the can or for a drink of water. Anything you see in the open from the door to the bathroom/kitchen is fair game. Intentionally wander into the basement and find the meth lab? Not admissible according to the letter of the law. On the other hand, lets say they go flying through your trailer while chasing some car thief and find it full of pot plants. No warrant? No problem, they were acting in good faith while carrying out their duties, and you just got unlucky.
People need to be aware that there is almost always a way for a smart LEO trying to do his job to let people shoot themselves in the foot. It's good for us when an honest, switched-on LEO is following a hunch, and catches someone who needs catching... not so much if they're just fishing because they don't like you, because let's be honest, virtually everyone breaks the law several times a day in some manner. You can't avoid it anymore.

It is generally unwise to allow the police into your home without a warrant.
If you aren't armed when you take a dump in your own home then your opinion on what is a practical daily carry weapon isn't interesting to me.
No they may not. You have not given up any of your rights just because you one a NFA item.
I believe the original poster did exercise one of his rights. The constitution was not violated. They asked permission to search and he exercised a right by allowing them to look. He did not have to let them in but he chose to. I am not saying I would or would not have done the same, but I do not believe there was any violation of our constitution. If there comes a time when you are asked exercise your right however you choose.
True, the person granting consent can limit the scope of a consent search. However, if officers are walking through the living room, with your permission, to get to the room you have granted permission for them to search and they happen to see contraband in "plain sight" they can seize it along with you and your residence until they obtain a search warrant, or you grant further permission to search.
Thanks for all of the information guys. If the BATF would have randomly showed up at my door, I probably would have done the same thing. However, now after everyone's information, I will be more prepared if it ever happens to me.

You know what scares the **** out of me?
What if you are at a range and your firearm doubles because it is malfunctioning, then some goody two shoe mother****er decides to get the ATF after you.
What happens then? What happens when you have a malfunctioning firearm and the ATF have a search warrant at your front door the next day?
Your life is practically over?![]()
You guys are acting like if you tell them to get a warrant, that they are just going to go away and never come back. When in reality they will go get one, they will have someone waiting at your house the whole time until they get one, and if you leave they will search your car. When they get back with the warrant they will search your whole house just to make sure you didnt hide your machine guns.
If there is an attorney or someone that knows the law (just fact based law, no opinions or hear-say) please clarify info. I figured if I said 'no' to a search, based on their reported accusations, I would have looked guilty or hiding something. Allowing them to come in showed that I was cooperative, and what I have is legal, so IMO saying no would just prolong the inevitable. They were there to do a job and its because of a vindictive acquaintance. I just hope that filing a false report w/ a federal agent is a crime. Thanks guys again for the words of advice, I appreciate it. BTW, it took me 4 hours to clean up the mess!
