    How many SBR uppers can you own if...

    I know this has probabbly been beaten to death and I didn't find it searching.

    I know once you get your form 1/4 approved for your SBR lower you can have any number of uppers as long as you can return it to the original configuration (assuming you haven't called to ammend the form). My question is what if I have stripped/complete non NFA lowers without a matching 16.1 or greater upper on it by I have exra SBR uppers laying around?

    EX: Let's say I have the following in the safe

    5 Regular AR 15's non NFA and all assembled in their various arrangements.

    2 Stripped/completed lowers

    1 SBR complete gun in it's original barrel length shown on the form 1/4

    2 SBR uppers that are used occasionally on the SBR lower.

    Am I legal to have the 2 SBR uppers that are not mated to anything while having stripped/complete non SBR lowers in the safe that those NFA uppers could easily be pinned to to make an illegal weapon if it was done, ie constructive intent? Or, am I ok since I have the one SBR lower even though I have stripped/complete lowers sitting there next to it?

    ETA: This is my first dive into Form 1 SBR's. I own 3 cans but no SBR's...yet, paperwork sent 6/25.

    As long as you can use all the parts you own in/on a firearm you legally own, then you are fine.

    If you have regular lowers, no NFA lowers nor a AR pistol, and an short upper, then you are in trouble.

    Never have any loose NFA uppers on hand if you have completed non-NFA lowers on hand.

    That is to say, if you have multiple NFA uppers, be sure any non-NFA is a complete rifle.

    5 SBR Uppers + 1 NFA Lower is fine.

    5 SBR Uppers + 1 NFA Lowers + 2 completed non-NFA rifles is fine.

    5 SBR Uppers + 1 NFA Lowers + 2 completed non-NFA rifles + 1 completed lower: not fine

    This last one can get you in an 'intent to construct' pickle. In theory you could construct a SBR illegally with those components.

    Any number of non-NFA uppers at anytime is just fine.

    And exactly how does one get into the "intent to construct" pickle when they don't tell anyone in the first place? As far as I know it has never happened.

    glad i read this thread, as i am in the process of getting a tax stamp for one of the BCM sbr lowers. no multiple uppers for me, after reading this. i guess i'll just stick with a BCM 12.5.

    Erase your post. You stated you have an SBR, more than one upper for it and other non-NFA lowers that have no legal configuration.

    Those five complete 16" AR15s are fine because they are all assembled in a legal configuration.

    Your two incomplete lowers are the problem. But two legal uppers for them or register them as SBRs for those other SBR uppers you have.

    It's no reason to run and cry but you are technically breaking the rules. Period.
