I really don't see the need for a lawyer. You fill out a trust, get it notarized and then send in the paperwork to the BATF with a copy of the trust. Many people use Quicken software to create the trust even.

Yes, any trustee can be in possession of the items that the trust owns. Regarding children, NFA laws require an owner to be 21 I think so that would likely rule that out.
The divorce issue might complicate things. However, a key here is that the trust owns the items, not the individuals, though they can take any legal action they'd like to as trustees.
I don't think that a trust would entirely remove the chance for a spouse to receive items or $$ in lieu of said items in the case of a divorce, especially if the other divorcing party was the only member of the trust.
Think of it like a company that you own and that company owns things. There are certainly situations where payments occur based on that company's value if the right circumstances are met and laws allow.

The most effective trust will be created specifically for your situation. I suppose that's where the lawyer comes into play.
My buddy and I are going on the assumption that no one is going to get litigation happy, ever. Or married. =)
You don't need an attorney in Austin itself; any Texas attorney with trust experience can put one together. I used Sean Cody out of Houston and he did a fine job. It is smart to use an attorneyinstead of relying on a computer program; I personally know one person who put their own trust together and inadvertently left out the parts that make the trust a legal entity instead of nothing at all.

Funny you asked, I just went the Trust route this past weekend, I went with a lawyer from Austin, he is NFA friendly, and a great guy to work with, he did everything, even the Notary (his wife) all I had to do was sign for about 10 minutes, give him a call- James Willi @Willi law firm, (512) 288-3200 Tell him David referred you,
(nothing in it for me) I wanted to do it right with no BS, cost was a non issue... good luck.
