I could understand why that would light a fire under you. So, after doing a little more reading I was turned to doing a trust instead of going to the sheriff. I called the ATF office here and his opinion was to do a trust because I am in the military and I might have to move to other areas that the sheriff will not apporve. Would this be a good idea? I have read in different areas that some agree and some dont any opinions?

If you can get a LEO to sign off, do it that way. Trusts (in PA) are not registered with the state and as such go through no vetting process. I don't want the only thing between me and jail time being a piece of paper that may or may not be composed correctly. I've never seen anything about someone going to jail over a typo on their trust, but that doesn't mean it hasn't or can't happen.

I believe when you move into another area, you just notify the ATF by mail where you're moving to--there is not another LEO sign off. You do need to notify them at least a certain number of days before you move, but I'm not sure how many days it is. I'm not positive about all the information here so it's definitely something you should double check, but I'm 98% sure there is not another LEO sign off.

Trusts IMO are best left to people who live in an area where it is legal but cannot get a LEO to sign off. They can also be good if you want co-ownership of your NFA item with a spouse or other family member, for instance. If you do decide to go the trust route, please use a lawyer who specializes in NFA trusts to draw it up; the going rate is $300-500 the last time I checked.

Thx for the info, doing the trust just seems like a headache to begin with. I think I will just do the LEO way and call it good.

You need to check with the NFA Branch as that is who has to approve it. Unfortunately the local ATF offices know very little regarding NFA firearms.
