I've testified in those situations as well.

Had to testify in arbitration last month for a guy who was suing us because he claimed we beat him up.

What actually happened: The guest was pointed out to me by a busboy as being extremely drunk. Since it was our Sunday night pool party, he was shirtless. He was sitting on a curb around a ivy covered large metal planter. He tried to stand up, but he was too drunk to stand, so he fell back into the planter, and slid down it, scraping the shit out of his back. Before my supervisor and I got to him, he did it again. When we saw him bleeding, we tried to offer him medical assistance and take him to the medics we have on staff before we removed him from the club. This resulted in him freaking out and punching my boss in the face, which led to him being restrained on the ground. One of his friends also tried to jump on my boss's back, which led to him ending up on the ground as well. His lawsuit, and his 4 witnesses (all his friends, and all with completely different stories), stated that he wasn't drunk, he slipped on water, and that we eye-gouged and choked him. His friends also stated that we were Samoan, and a bunch of Samoans beat him up. I'm Irish, and my boss is Italian. There weren't any Samoans there. His lawyer also said that, because of my size, I could hurt someone if I wanted to, to which I responded "So you're saying because I'm fat, it means I like beating people up?". That got alot of laughs, and ended his line of questioning. Needless to say, his suit got thrown out. Apparently his lawyer was his girlfriend's dad or something, the guy filing suit was a busboy at another club.

That's the kind of dumb shit I have to deal with on a regular basis.

    Take Care,

I further clarified procedure, what part don't you agree with?

That's pretty funny. You're sound like a pretty good guy Rider79.

For the record, I think Samoans are delicious. My favorites are Thin Mints, though.

Actually your last clarification makes it much more clear than the original statement i "latched" onto. It wasn't personal, just some misunderstanding.

I think we both got off on the wrong foot from the beginning. You got fired up with the broad brush statement about your profession from someone. I got fired up with your more power than metro statement. I think we both took them out of the intended context.

Of course I'm not telling you that. Use some common sense. Don't be a victim of a crime, but if you resist because you think you're right, well, you better be ****ing right!

Nevada is easily one of the top ten states to live in (in my opinion), no state income tax, permissive gun laws, strong laws for protecting yourself and your castle, and loads of open space that is everybody's land... I have few complaints.

donr101395- thank you; accepted. Obvious miscommunications, mostly, I imagine, due to this being written word instead of a conversation.

    kartoffel, this is exactly correct.
Detaining someone against their will is only kosher if...
    - it's a misdemeanor that you directly witness
That is why I posted earlier that if you're arrested you shouldn't resist. If they watch you shoplift, pander, trespass, commit battery, affray, etc..., then you're not going to have a leg to stand on if they arrest you and you resist with some sort of violence.

Like I said, NV's private property laws are pretty broad, and they give the casino operators alot of leeway. When Metro is on property, they have to follow procedure that the casino doesn't. Terry v. OH doesn't apply to casino security. Plus its posted at every entrance that you and your effects can be subject to search.

The only leeway is if the person is suspected of committing a felony, and if that's the case they need to ask what felony they've committed and if one is given they need to ask for metro and only give any identification to LE when they arrive on site, as well as call their lawyer.

Casinos get sued regularly for this, and professional gamblers have attorneys who specialize in just such cases due to harassment, and unless I'm some type of douche bag with a long record chances are the jury will see things in my favor.

Backroom harassment today isn't what it was in the 80's, you improperly detain somebody and you're looking at criminal and civil problems.

I understand too is an adverb and to is a preposition, I still prefer using to in place of too.

The way I see it I'll save maybe 5-10 minutes over my lifetime not typing that extra o at the end of to. Even typing up this explanation saves me more time than typing that extra o

I know that alot of these people are escorted directly out of the casino, without going to holding at all. Card counting isn't illegal but they don't want them there. Security will walk the person right out the door after asking for ID and reading the trespass, then survelliance will pull the photo off the camera footage. Hookers are taken care of this way too. The only time they have hookers in holding is if they've been trespassed previously and they're holding them for a misdemeanor citation with Metro. Or if they've committed another crime on top of hooking.

Can't argue with that, it's perfectly legal to kick some one out of your place of business
