It came with a hard case with Bushmaster logo and serial number, so I believe it was factory built.

Anything's possible, but all factory A2/A4 Bushmasters that I've seen came with the standard A2 flash suppressor. That muzzle brake looks aftermarket. Also looks like your carrier key needs to be staked.
I was told it was built to the DC market, slip on non threaded muzzle brake maybe legit.

Bushmaster did offer a carbine with a permanently attached AK-74 style brake on it, the “Shorty AK” I believe it was called. Not impossible they might have done a run of rifles with them too.
It may be a “ban” gun, but with changes post ban
