We all know that no state only has two infections, if there are two then that just means only two have tested positive. Glad to see he is not for a national quarantine though, hopefully we get this whole testing debacle figured out and that will help get things back to normal faster.

He was referring to quarantine / isolation of known cases. And his point was that this is something the states need to decide not the feds. What NY or CA needed might not be appropriate for other states.

Shoot, my town just converted a 7 story Radisson hotel to a Federal quarantine center.

Kansas City and surrounding counties issue a stay at home order for 30 days after that they will reevaluate. Those people and businesses that are deemed non-essential it could be a rough month.

You can talk about the Constitutionality and wording here and there, but stuff like this even predates common law. When you are talking about plagues and stuff like this, it isn't a cross the eyes and dot the tees kind of thing. It's the common good, or else the high spots are going to get sanded down. Of course, when the high-spot has sandpaper too...

I keep seeing mentions off all these quarantine locations. I can't figure out if those are overflow treatment areas or are they areas for negative people? At risk poeple and they reverse quarantine them? Considering how many could be infected and not have any negative outcome, I don't see them rounding up all the 'positive' people.

Like most things with Judge Napolitano, reading these articles I find myself agreeing with various supporting points but not agreeing with the leap that he made. Which is not real clear in the articles other than that he doesn't believe a national quarantine action would stand the test of law.

So what are you do with the guy who is sick and will not go into isolation? What do you do with the partiers on the beach that are walking, talkin infection vectors back to other parts of the country and their family?

Personally I think there's a middle ground. And I don't believe there will be a national level action other than allowing the federal military to help States with hospitals, food, water, manpower.

If these things get challenged in court you will probably see the first time in American history where the Judicial Branch of government is completely ignored. Rule of law is what we're about (in theory ) but we've never experienced something like this. We are in uncharted waters.
